WELCOME TO ALASKA EQUIPMENT AND FLEET AUCTIONS,

THIS AUCTION IS AN ONLINE/TIMED AUCTION.

IF IT IS YOUR FIRST TIME REGISTERING TO BID ONLINE WITH AEF AUCTIONS, YOU WILL BE ASKED TO PROVIDE CUSTOMARY BILLING INFORMATION SUCH AS NAME, BILLING ADDRESS, AND CREDIT CARD INFORMATION. A $1 NON-REFUNDABLE CREDIT CARD VALUE AUTHORIZATION CHECK WILL BE PART OF VERIFYING YOUR IDENTITY.

IF YOU PURCHASE AN ITEM THERE IS AN ADDITIONAL 13% BUY FEE.  THERE IS A 4% ADDITIONAL CHARGE FOR CREDIT CARD PURCHASES, WITH A LIMIT OF $5,000 THAT CAN BE CHARGED ON CREDIT CARDS PER AUCTION. CREDIT CARD MUST BE IN REGISTERED BIDDERS NAME.
THE CREDIT CARD USED TO MAKE PAYMENT MUST BE DISPLAYED AT TIME OF REMOVAL OF PURCHASED ITEMS.   IF CREDIT CARD IS NOT AVAILABLE, AND A POWER OF ATTORNEY IS PROVIDED IN LIEU THEREOF, REMOVAL OF PROPERTY MAY BE DELAYED UNTIL THE IDENTITY OF THE REMOVING AGENT CAN BE VERIFIED WITH THE BUYER.

The following charges will apply on all purchases:

IF YOU HAVE REGISTERED AS A COMPANY, ALL SALES AND TITLE DOCUMENTS WILL BE COMPLETED IN YOUR COMPANY NAME.
Lot/item descriptions are provided for convenience and are only a guide. Descriptions may not be accurate. It is your responsibility to inspect all items and verify descriptions before bidding. All items are sold “as is” “where is”, and all sales are final. The auction reserves the right to remove items from auction or skip items once the auction has begun. Lot/item numbers may change up to the start of the auction. It is the bidder’s responsibility to verify they are bidding on the correct lot/item.

In these Terms and Conditions, AEF Auctions shall mean Dealers Auto Auction of Alaska, Inc. DBA: Alaska Equipment and Fleet Auctions.

PAYMENT:
All purchases made must be paid for in full by 5pm Friday, December 20th, 2019. Approved methods of payment are: Cash ( maximum of $5,000.00) credit card (Visa or MasterCard), cashier’s check (Made payable to Alaska Equipment and Fleet Auctions) or EFT. MAXIMUM AMOUNT THAT CAN BE CHARGED TO CREDIT CARDS PER AUCTION IS $5,000.00. Credit card must be in bidder’s name.

BUYERS FROM OUTSIDE THE UNITED STATES MUST TENDER ALL PAYMENTS VIA WIRE TRANSFER.
NOTICE – Policy for International Buyers: All international buyers must provide a current, valid passport for identification purposes and a $10,000.00 deposit prior to bidding. The deposit must be made with US
funds in form of wire transfer.

REMOVAL:
Purchases must be removed from the sale site within 10 business days of the auction date. You will not be entitled to take possession or control of any lot until you have made payment in full for all lots purchased by you. Loading will be on Monday through Friday from 9:00 AM to 4:00 PM. Any equipment remaining on the grounds after 10 business days will be subject to storage fees or removed at the buyer’s expense. If item(s) are not removed within 10 business days, the buyer agrees to pay a storage fee of $35 per item, per day, beginning on day 11, to AEF Auctions. Any items not removed within 30 calendar days from date of auction will be deemed abandoned by the buyer and will become the property of AEF Auctions. The buyer will still be liable for the storage fee of $35 per day, per item. SHIPPING ARRANGEMENTS AND COST ARE THE BUYER’S SOLE RESPONSIBILITY. Purchases become the responsibility of and shall be and remain at the risk of the Purchaser immediately upon acceptance of bid. It shall be the responsibility of the Purchaser to insure their purchases immediately.

No sale shall be invalidated by reason of any defect or inaccuracy in any of the lots by reason of their being incorrectly described in this listing or elsewhere, and no liability shall be borne by the Auctioneers in respect of any such fault or errors. These listings have been prepared only as a guide based on information from sources generally believed to be reliable and from the Consignor, but the accuracy thereof cannot be guaranteed or warranted by the Auctioneers. Bidder acknowledges that it is their responsibility to inspect all equipment and to make their own inquiries. AEF Auctions reserves the right to remove items from auction or skip items once auction has begun. Lot/Item numbers may change up to the start of the auction. It is the bidder’s responsibility to verify they are bidding on the correct lot/item.

There shall be no guarantees or warranties, expressed or implied, statutory or otherwise of any nature whatsoever. There shall be no implied warranties of merchantability and fitness for a particular purpose.

AEF Auctions and its Employees act merely as agents of sellers. All auctions are with reserve unless specifically stated otherwise. Reserves, if any, ARE NOT disclosed. Additionally, at some auctions, bids may be placed by the seller, an employee of the seller, or an agent on the seller’s behalf, up to the reserve.

Bidder acknowledges the inherent dangers of an industrial auction yard. Every bidder (and their agents and employees) at the Auction site before, during and after the auction sale shall be deemed to be there at their own risk.

AEF Auctions provides online bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against AEF Auctions or anyone else if the Internet service fails to work correctly before or during the live auction. INDEMNIFICATION: You agree to indemnify, defend and hold harmless AEF Auctions and its employees, agents, affiliates, successors, officers, directors and assigns, from and against any and all loss, liability, claim, action, cost and/or expenses (including attorney fees) resulting from, arising out of or relating to your breach of and/or failure to comply with any term, condition, restriction, representation and/or warranty set forth in this Agreement.


PAYMENT DEFAULTS: If you fail to pay any sum when due, you agree to pay interest accruing from the due date at the rate of 18% per annum (or at the maximum rate allowed by law, whichever is less), together with any legal and/or collection costs, including attorneys' fees, incurred as a result of your non-payment and/or in connection with the collection of any sum past due.

GOVERNING LAW: To the extent that this Agreement is construed, interpreted and/or enforced in connection with a particular Auction, it shall be construed, interpreted and/or enforced in accordance with the laws of the State in of Alaska.
